2. DEFINITIONS
- Website — the web platform accessible at chichubcafe.ro and its subdomains.
- User — any natural or legal person who accesses and/or uses the Website.
- Customer — a User who places an Order through the Website.
- Order — a purchase request for products available on the Website, submitted electronically.
- Operator — S.C. CHIC HUB CAFE S.R.L.
3. PURPOSE
These Terms and Conditions govern access to and use of the Website, including placing online orders, making reservations and using the loyalty programme, in accordance with applicable Romanian legislation: Law No. 365/2002 on electronic commerce, GO No. 21/1992 on consumer protection, Law No. 449/2003 on the sale of products and associated guarantees, and Regulation (EU) 2016/679 (GDPR).
By using the Website, the User declares that they have read, understood and fully accepted these Terms and Conditions.
4. PRODUCTS AND PRICES
4.1. The Operator sells through the Website prepared food and beverage products (coffee, drinks, pastries and other culinary preparations) and other associated products (coffee beans, merchandise), subject to availability.
4.2. Prices displayed on the Website are expressed in Romanian lei (RON) and include VAT.
4.3. The Operator reserves the right to change product prices at any time without prior notice. The applicable price is the one displayed at the time the Order is placed.
4.4. Product availability may vary depending on the selected location and stock available at the time of ordering.
5. ONLINE ORDERS
5.1. Placing an order. The Customer selects the location, order type (pickup or dine-in), desired pickup/serving time and the desired products, then places the Order.
5.2. Scheduling. Orders may be placed with a minimum of 30 minutes and a maximum of 48 hours before the desired pickup or serving time.
5.3. Order confirmation. After payment is completed, the Customer receives an e-mail confirmation with the order details. The Order is automatically transmitted to the selected point of sale.
5.4. Order types:
- Pickup: The Customer collects the order from the selected location at the scheduled time.
- Dine-in (sit-in): The order is prepared for on-site service. The Customer is asked to specify the number of guests.
5.5. Customer responsibility. The Customer is responsible for the accuracy of the information provided (name, phone, e-mail, pickup time). The Operator cannot be held liable for delays or errors caused by incomplete or incorrect information.
6. PAYMENT METHODS
6.1. Payments are processed online via bank card through the Stripe payment processor. The Operator does not store bank card data; all card information is managed entirely by Stripe in compliance with PCI-DSS standards.
6.2. Cash payment upon pickup is available where explicitly indicated on the Website.
6.3. Customers holding value vouchers issued by the Operator may use them at checkout, with the voucher value applied automatically.
6.4. The Order is transmitted to the point of sale only after payment confirmation.
7. ORDER CANCELLATION
7.1. The Customer receives a reminder e-mail 30 minutes before the scheduled time. Within this e-mail, the Customer has the option to cancel the order.
7.2. In case of cancellation, the Customer may choose:
- Refund via the same payment method used, within a maximum of 14 business days; or
- A value voucher of the same amount, usable for a future purchase.
7.3. Cancellation is no longer possible once the order has entered preparation (status "In Preparation" or later).
7.4. The Operator reserves the right to cancel an order if the ordered products are no longer available, in which case the Customer will be notified and will receive a full refund.
8. RIGHT OF WITHDRAWAL
8.1. In accordance with Art. 16(d) of Directive 2011/83/EU and Romanian GO 34/2014, prepared food products made to order (coffee, beverages, food) are exempt from the 14-day right of withdrawal, as they are goods liable to deteriorate or expire rapidly.
8.2. For non-perishable products (sealed coffee beans, merchandise), the Customer is entitled to the right of withdrawal within 14 calendar days of receipt, provided the products are returned in their original packaging, unopened and in a marketable condition.
9. RESERVATIONS
9.1. The Website allows table reservations at the Operator's points of sale.
9.2. Reservations are made by completing the dedicated form, specifying the date, time and number of guests.
9.3. Reservation confirmation is sent by e-mail. The Operator reserves the right to decline or modify a reservation based on availability.
9.4. The reservation cancellation policy will be communicated at the time of confirmation or updated within this page.
10. LOYALTY PROGRAMME
10.1. The Operator may offer Customers a loyalty programme, accessible through a dedicated platform.
10.2. The rules for earning and using loyalty points, as well as associated benefits, are described within the loyalty platform and may be modified by the Operator at any time.
10.3. Loyalty points have no monetary value, are non-transferable and cannot be converted into cash.
11. PERSONAL DATA PROTECTION
11.1. The Operator processes Users' personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable national legislation.
11.2. Data collected through the Website (name, e-mail, phone, address, order preferences) is used exclusively for order processing, reservation management, service-related communications and, with the User's express consent, for marketing purposes (newsletter).

11.4. The User may request access to, rectification, deletion or portability of their data, as well as withdrawal of consent, at any time by sending an e-mail to office@chichubcafe.ro.
12. INTELLECTUAL PROPERTY
12.1. All Website content — texts, images, graphics, logos, design elements, source code — is the property of S.C. CHIC HUB CAFE S.R.L. or its licensors and is protected by copyright law.
12.2. Reproduction, distribution or use of the content without the Operator's prior written consent is prohibited.
13. LIMITATION OF LIABILITY
13.1. The Operator makes all reasonable efforts to ensure the proper functioning of the Website and the accuracy of the information presented.
13.2. The Operator cannot be held liable for:
- Temporary interruptions of Website functionality due to maintenance or force majeure;
- Errors of payment service or communications providers;
- Damages resulting from improper use of the Website by the User.
14. COOKIES

15. DISPUTE RESOLUTION
15.1. Any dispute between the Operator and the User shall be resolved amicably. If no agreement is reached, the dispute shall be submitted to the competent courts of Bucharest.

16. FINAL PROVISIONS

16.2. Continued use of the Website after the publication of amendments constitutes tacit acceptance of the new Terms and Conditions.
16.3. These Terms and Conditions are governed by the laws of Romania.
